I’ve written a couple of blogs (the latest being Do You Have an HOA Dispute? Part 2) about how a homeowner to contest a notice of violation or fine by a Homeowner’s Association. It is an alternative to the civil court system administered by the Arizona Department of Real Estate (“ADRE”). What are the top 3 issues brought before the ADRE? In the period from July 2019 to the end of the year, they were: the Board acting without authority, architectural design violations, and common property maintenance. During that time 17 cases were filed, and 10 went to hearing – with the petitioner wining 2 of those. So it looks like the HOAs are prevailing most of the time.
