Part 1 discussed the necessity of investigating neighborhood horse privileges under CC&Rs. But even if there are no CC&Rs or they are silent, governmental regulations also impact the legally of equine ownership. In Phoenix the Zoning Ordinance restricts the keeping of horses to occupant (or tenant) owned single-family residential property of 10,000 sq. ft. or greater. The boarding of horses owned by others is not permitted. There is no limitation on the number of horses which may be kept, so long as they are all occupant/renter owned. Phoenix also has regulations regarding nuisances due to a presence of flies, odors, dust or accumulation of manure (must be removed at least twice each week. Scottsdale has similar requirements without the 10,000 sq. ft. requirement. Next in Part 3: County and Other City Regulations.
